Terms of service
1. General Provisions
1.1. These electronic store terms and conditions (hereinafter – the "Terms") constitute a legally binding document for the Buyer and the Seller, establishing the rights and obligations of both parties.
1.2. The Seller reserves the right to amend, correct, or supplement these Terms at any time. Buyers will be notified of any changes via the online store website.
2. Formation of the Purchase Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer places and submits an order in the online store, having first read and accepted these Terms.
3. Seller's Rights
3.1. In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store, or breaches their obligations, the Seller has the right to restrict or suspend the Buyer's access to the online store without prior warning.
4. Seller's Obligations
4.1. The Seller undertakes to provide access to the online store services in accordance with these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method selected by the Buyer, in accordance with these Terms.
4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the ordered goods, the Seller has the right to terminate the purchase agreement after notifying the Buyer. The Seller may offer an equivalent product. If the Buyer declines, the Seller undertakes to refund all payments within 3 business days.
4.4. If the Buyer exercises the right described in clause 5.2, the Seller undertakes to refund all payments within 5 (five) business days from the date of receipt of the returned goods.
4.5. The Seller may withhold the refund until the goods have been returned or until the Buyer provides proof that the goods have been dispatched to the Seller, whichever occurs first.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery.
5.3. The right described in clause 5.2 may only be exercised if the product has not been damaged, its appearance has not substantially changed, and it has not been used.
6. Buyer's Obligations
6.1. The Buyer must pay for the purchased goods and accept delivery in accordance with these Terms.
6.2. If the Buyer refuses to accept the goods upon delivery without valid reason, the Buyer must cover the return shipping costs upon the Seller's request.
6.3. Upon delivery, the Buyer must inspect the condition of the shipment and the goods together with the Seller or the courier.
6.4. By using the online store, the Buyer confirms that they agree to and will comply with these Terms.
7. Prices
7.1. All product prices are listed in Euros (EUR), inclusive of VAT. A delivery fee may be added to the total order value at checkout, where applicable.
8. Ordering and Payment
8.1. The Buyer selects products and adds them to the shopping cart. When placing an order, the Buyer provides their name, surname, delivery address, phone number, and any additional delivery instructions. The Buyer confirms that they have read and agree to these Terms before completing the order.
8.2. Payments can be made via Visa or Mastercard and other payment methods available at checkout. All payments are processed in Euros through the MakeCommerce.lt payment platform.
9. Delivery
9.1. The Buyer must provide an accurate and complete delivery address when placing an order.
9.2. The Buyer is responsible for receiving the goods themselves. If the goods are delivered to the specified address and accepted by another person, the Buyer may not raise claims regarding delivery to an incorrect recipient.
9.3. The Seller delivers goods within the timeframes indicated in each product description.
9.4. The Seller is not responsible for colour, shape, or other visual discrepancies between the product images on the website and the actual product, due to monitor or display settings.
9.5. If the Buyer cancels their order, all payments including delivery costs paid by the Buyer will be refunded.
10. Returns
10.1. Quality goods may be returned within 14 days of receipt. Defective goods will be repaired, exchanged, or refunded in accordance with applicable law.
10.2. The following conditions apply when returning goods:
- 10.2.1. The product must be returned in its original, undamaged packaging (this does not apply to defective products);
- 10.2.2. The product must not have been damaged by the Buyer;
- 10.2.3. The product must be unused and retain its original appearance, with all labels and protective films intact (this does not apply to defective products);
- 10.2.4. The product must be returned with all original accessories and components (this does not apply to defective products);
- 10.2.5. The Seller reserves the right to refuse returns that do not comply with these conditions;
- 10.2.6. Returns must be initiated within 14 (fourteen) days of receiving the goods using the method designated by the Seller (for defective products, the statutory warranty period applies).
10.3. Refunds for accepted goods that are subsequently returned will be issued to the Buyer's account within 5 (five) business days from the date the Seller receives the returned goods, unless otherwise agreed.
11. Final Provisions
11.1. These Terms are governed by the laws of the Republic of Lithuania.
11.2. All disputes arising from these Terms shall first be resolved through negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.3. The parties are released from their obligations under these Terms if fulfilment is impossible due to unforeseen circumstances beyond the control of the parties (force majeure).
